A justiça de Nova York negou o pedido de liberdade para o ex-presidente da Conmebol, o paraguaio Juan Ángel Napout, de 61 anos, devido ao coronavírus, mas afirmou que estudará um regime de prisão domiciliar sob pagamento de fiança enquanto o réu apela da decisão.
Preso na Suíça em dezembro de 2015, Napout se declarou inocente diante de uma corte nova-iorquina de aceitar propinas milionárias de empresas esportivas em trocas de contratos, mas foi declarado culpado por um juri popular dois anos depois. O ex-dirigente foi sentenciado a nove anos de prisão em agosto de 2018.
Os advogados de Napout pediram a libertação do cliente por motivos humanitários devido à pandemia do coronavírus, mas, como o pedido não foi aceito, buscam agora que o paraguaio cumpra a sentença em prisão domiciliar em Miami por seis meses, ou até o anúncio do resultado da apelação.
“As pessoas na prisão têm um risco muito maior de contrair a doença”, justificou o advogado de Napout, Marc Weinstein.
Ao fim de uma audiência realizada por telefone devido ao coronavírus, a juíza federal do Brooklyn Pamela Chen, encarregada do caso de corrupção na Fifa desvendado em 2015 pelo governo americano, declarou que tomará uma decisão sobre uma possível prisão domiciliar em um futuro próximo.
O Ministério Público se mostrou contra a possibilidade de prisão domiciliar, afirmando que Napout teria condições de fugir dos Estados Unidos.
Napout tomou a palavra brevemente para negar que pretendia fugir: “Nunca poderia ser um fugitivo, não é de minha natureza”.
Ao sentenciar Napout em 2018, a juíza Chen declarou que o ex-dirigente tinha “uma personalidade oculta” e “perpetuava a noção de ser um cara legal ao mesmo tempo que recebeu 3,3 milhões de dólares em propina e aceitou receber outros 20 milhões”.
Em 30 de março, em meio à pandemia, a juíza Chen concedeu liberdade provisória por questões humanitárias ao ex-presidente da CBF José Maria Marin, de 87 anos, julgado no mesmo processo de Napout e condenado a quatro anos de prisão.
